Exciting times for transfer pricing!
The OECD’s Pillar 1 Amount B is reshaping the international tax landscape, aiming for a more streamlined and consistent approach to profit allocation. This initiative aims to simplify transfer pricing for baseline marketing and distribution activities, making compliance easier for multinationals.
After several discussions with our clients, it appears that Amount B is not a simple approach to determining arm’s length target EBIT margins for baseline distribution activities. There are many uncertainties that need to be clarified by the OECD or member states as soon as possible. Our experience is also that there are significant operational TP challenges, but also opportunities. For example, how to set up the logic to create P&L segments that allow or disallow the application of Amount B. Both outcomes can be interesting from a tax planning perspective. Do we need to exclude individual products from a baseline distribution segment if they are commodities? This seems to be very important for chemical and pharmaceutical multinationals. How should net assets be (intelligently) allocated to segments? In which countries should a multinational decide for or against Amount B (if the country accepts Amount B and if the taxpayer is allowed to make a choice) and what is the ETR impact?
